These Terms of Service ("Terms") govern your use of promerchpps.com and the services offered by ProMerch LLC ("ProMerch," "we," "our," or "us"), a California limited liability company. By accessing or using our site, you agree to these Terms.

Use of the Site

You must be at least 18 years old to use our services. You agree to use the site only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials.

Products and Pricing

All products are subject to availability. Prices are listed in USD and are subject to change without notice. We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent or that exceed quantity limits.

Orders and Payment

By placing an order, you authorize us to charge your payment method for the total amount including product, shipping, and applicable taxes. All payments are processed securely through Stripe. We do not store payment card information.

Shipping and Delivery

We ship to the United States, Canada, and Mexico. Delivery estimates are provided at checkout and are not guaranteed. Risk of loss and title for products pass to you upon delivery to the carrier.

Returns and Refunds

Due to the nature of our products, all sales are final unless the product arrives damaged or defective. If you receive a damaged or defective product, contact us at info@promerchpps.com within 7 days of delivery with photos and your order number.

Intellectual Property

All content on this site including text, graphics, logos, and product designs is the property of ProMerch LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Warranty

Avant-Guard PPS products are backed by a 10-year limited warranty against defects in materials and workmanship under normal use and service conditions. The warranty does not cover damage from misuse, improper application, or unauthorized modification. Warranty claims must be submitted to info@promerchpps.com with proof of purchase.

Limitation of Liability

To the fullest extent permitted by law, ProMerch LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or services. Our total liability shall not exceed the amount you paid for the product giving rise to the claim.

Governing Law

These Terms are governed by the laws of the State of California without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in California.

Changes to These Terms

We may update these Terms from time to time. Continued use of the site after changes constitutes acceptance of the updated Terms.
